EAD Usage

Hi Friends,


I have worked with my sponsoring employer for first 2 months of filing the Labor. After that i changed 2 companies. But my sponsoring employer supported me in all means. I have got my labour approved and then in December 2002 i filed my 485/EAD/I-140/FP. I got my EAD/I-140/FP approved in February 2003. Waiting for the final approval :-) :-). My RD is 12/07/03.

I am currently working on H1-B visa though i hold EAD card for the GC sponsored my Sponsoring Employer.

Question is i got a better opportunity and want to join from Current H1-B employer to another employer (different from Sponsoring Employer). Can i use my EAD card to join the new employer?

Will there be any chances in future the Officer going to process my case will raise an RFE or intent to reject my GC Process since i worked on EAD with different employer rather than sponsoring Employer??

I have to make major decision on you all responses. Please all of you respond to build my confidence.

I guess working on ead for a differnt company should not be a problem as greencard is for future employment. Also you mentioned that you are no longer working for the gc sponsoring employer.

But let's wait and see what the gurus suggest!!!!!!!!
 
what do you mean by My RD is 12/07/03? Is it 12th of July, suppose to be because we are in August 2003 only.
Further if you want to use EAD and change the employer better to wait till completion of 180 days of filing your I-485 i.e after approval of your I-140.
 
It is not a matter whether you worked for GC sponsoring company or not. As for EAD is concerned you can use it for any employer.

As you mentioned if you have approved I-140 and your I-485 is pending over six month (you applied I-485 December -2002 right?) Then you should not have any problem.

The BCIS memo, which was released on August 4th, says clearly about this. Please check in other threads where this discussion is going on

In my case i am transferring my GC Process to new employer. My GC Process will be still supported by my Sponsoring Employer. But i am working on H1-B visa with current employer and i got a new job for which i need to work on EAD only.

I have a concern whether though my Sponsoring employer still supporting for GC , can i work for another employer using EAD or only EAD should be used to work with sponsoring employer only.
