My sister is getting leave of absent from her company to go to Thailand for several months. If she like it there, she may never return to the US. Right now she has I-140 approved, I-485 filed together with I-140 in late 2002, and EAD and AP. She has received her extended EAD and AP which expires in January 2005.
Based on the waiting period posted here for Chicago where her application is being filed, she has maybe one or more than one year before her I-485 can be possibly be approved.
The company is not very friendly to her, although allowing her to take leave of absence, they want her to pay 50% of her
GC application fee (which means around $2500) before she leave.
If she just resign from the job, would she has any problem coming back to the US using the AP, and use the EAD to look for a new job before the I-485 get approved, or before she get the RFE ?
Would the temporary absence from the US be a problem?
I ask this because it is very unlikely for the company to want to give her any job back even if she comes back after one year.
Another question is, if she can come back before I-485 result comes back, and get a job, can she file for extention for the EAD again beyond January 2005?
