If someone is on EAD and want to come back to H1 status (assuming the person has H1 time), what is the procedure? If they are already in US, can they file a new H1 and immediately start working? Or does the person need to go bacl to the home country US consulate and get a stamping and start working?
I am under the impression that the person can start working immediately and visa stamping is only for entry/exit. Will INS send a I-94 renewal too with the H1 approival notice? And if I have a previous H1 visa valid till 2006, can I remain in US without having to go to home country for stamping?
