Gurus,
I am going to Efile my EAD extension. What would be the start and end date on New EAD ? Does it start from last EAD expiration date or the date it gets approved?.

Thanks in advance
:)

Loose your unused days on EAD after extension ?

Minn, Thanks for your prompt response. Is It mean that you will loose your unused days on your previous EAD ?

Ead

I need a little help,

What should one enter for the question “Manner of Last Entry into the U.S.:” on EAD I-765 e-file application. I used Advance parole, but I don’t see that option there on the EAD I-765 e-filing application. Following are the options.

1) DA: ADVANCE PAROLE (DISTRICT AUTH)
2) DE: PAROLEE (DEFERRED INSPECTION)
3) DT: PAROLEE (DISTRICT/POE AUTH)
4) PAR: PAROLEE

Same is for the question “Current Immigration Status:”

1) DA: ADVANCE PAROLE (DISTRICT AUTH)
2) DE: PAROLEE (DEFERRED INSPECTION)
3) DT: PAROLEE (DISTRICT/POE AUTH)
4) PAR: PAROLEE

Thanking you,

Yes, I usually lose a month on each EAD renewal every year.
You can take the risk and apply in the last month. My last EAD got
approved in less than a month and I had applied 2 months earlier.

You should efile and promptly schedule your FP. Hopefully, it takes
less than 2-4 weeks after FP for approval.

Thanking you,

I don't have a AP so can't answer your question.
Your current Immigration Status has notthing to do with AP.
In my efile, I entered Alien of Dist Ability & merit. I think I had
gotten that from the forum here.. i guess. However, my EAD was approved.
You can also put that or wait for someone else to reply. However, I don't think your current status is any of the above that you have listed.

Should I apply after expiration ?

Minn, My H1 will be valid for another 3 months even after my current EAD expires ( I am still on H1 status) . Should I apply for extension after my current EAD expires to use my remaining H1 tenure and then swith to new EAD ?

Thanks again.

But my case the start will be from expiration of 2nd EAD...

2nd EAD I lost 2 months ..but third ead from expiration date

1st EAD : Start Apr 2004 and EXPIRED April 2005
2nd EAD : Approved on March1 2005 and valid to FEB 28 th 2006
3rd EAD : Approved on DEC 17 2005 ..start date from March 1 2006 valid up to FEB 2007

Why your second extension is different from first where start dates start after expiration of previous EAD ? Is the rule changed ?

rjaingc,

If you are planning on moving to EAD after your HI expires then apply for renewal 2 months prior to your HI expiring. I would transfer to EAD a couple of days before HI expires just to be on the safe side. You should check with your HR if they would need extra time for you to move from HI B to EAD. All I had to do was fax in a copy of my enlarged EAD card to HR.
I think you can renew your EAD even if its expired.

apol,
you are one lucky person unless they changed the start date of EADs to match the expiraton date of the previous EAD.

Thanks for your responses

Minn, You have been very helpful during this thread. I would like to thank you for your help :)

Thanks Guys I dont See that option in the Drop Down list.
Always file the paper based immigration petition instead of the e-filing unless you need to match the time. Then you can fill in the AOS. The CIS chap will know that.

check out this link ...might add an additional info to your sack.
http://www.immigrantlegaladvocacy.org/employer.html

If the employee has an Immigration work permit (EAD), the employer must reverify the employee's continued eligibility to work by the time that EAD expires. With some exceptions, notably refugees and asylees whose legal status entitles them to work even if they have an expired EAD, an employer cannot allow a person with an expired EAD to work until s/he gets a new, valid, EAD. Employers would be wise to remind the employee three months in advance of the EAD's expiration date to file to renew the EAD, because of lengthy Immigration backlogs in issuing renewed EADs. Immigration has acknowledged this backlog problem, at least for persons whose EADs are based on pending asylum applications (bearing the code C-8). If Immigration issues the EAD after the prior card has already expired, it backdates the new card to the prior card's expiration date, as long as the renewal application was filed before the earlier card expired. This policy protects both the employee and the employer if there is an inadvertent gap between the expiration of the old card and issuance of the renewed EAD.

I just dont know the authenticity of this article.
