Hi,
I am on EAD and i am prepared my GC will take another year.
Friend of mine has started a company and asking me to join as his partner. I still am going to work for my current company though.

I wonder if there are any special risks being a partner while on EAD status?
How does it work if for some reason there comes a gap between EAD renewal .. just wonder!!

Also i am planning for some small secondary incomes. I hope i am fine as i am with EAD... is that right?
 
You can work as many jobs as you like on an EAD and they don't have to be related to your GC field. (you could go flip burgers at McDonalds if you want to). I started my own company on an EAD with no problems. (I do still work full-time for my GC sponsor).

If you begin working on your EAD for your friend, you will lose your H1 status. You would have to switch to the EAD with your current employer also. (You'd have to find out from your employer if they have a problem with you working a second job). Also keep in mind that you would need to have a valid AP to travel outside of the US since your H1 would be invalid.

If there is a gap between valid EADs, you cannot work, at any job. Period. You cannot volunteer, work for free etc... You must sit on the sidelines until your new EAD arrives.

If one starts a company while on EAD. How do they handle if their EAD renewal doesn't come in time?

Lets say i along with my friend start a company. If my friends EAD renewal do not come in time, can he still be partner of the company?

Is it a violation?
 
You can still be a partner in the company, you just can't do any work for it during that time. Anybody can own a company regardless of their status. It's the working part that the USCIS cares about.

Just be sure to always apply for your EAD at least 90 days before it expires. That way if it doesn't come within the 90 days, you can go and get an interim EAD on the 91st day.
