Hi,
Today my wife's EAD online status changed to Request for more information (RFE). They did not mention the reason for RFE. I am assuming that some shadow in the photo. My questions are
1. Her AP got approved earlier this month, If her photo is the reason they have issued RFE, will they have approved her AP?
2. We did a concurrent I140/I485 for me and I485/EAD/AP for my wife. If photograph is the issue, we used the same photograph for her I485 application. So should I send new photographs for her I485 before they RFE her I485 ?
3. When we filed for I485/EAD/AP together we did not keep copy of her driving license or color copies of passport. Just her b/w photocopies of passport. Could this be an issue?


Typically after they receive the RFE response how long do they take to approve it?

I140/I485/EAD/AP RD for both us: 06/14/2004
Wife AP approval: 07/12/2004
Wife's EAD: 07/29/2004
No EAD/AP for me
 
Hold on dude....

You are running too fast here. You don't know if the RFE is for photo yet. You are just guessing. Don't send any info. to USCIS unsolicited. It will go waste. See what the RFE says first. You will have full 2 months to respond so take ur. time :)

SEcondly, I don't think you need to send color copies of ur. passport or driver's licence. Black and white are OK and I am sure all of us here have sendt only black and whites.

Once u send the RFE response generally they act on it within 15 days. BUt in some cases it may take months. If RFE is simple like photo, I am sure it will approved in a week's time after they get ur. response.

My main concern was can USCIS RFE for photo for EAD while approving AP with the same photo? If so, will i need to worry RFE for I485?
I am not planning to send any reply until my lawyer receives the RFE.
