Hi

I have applied my EAD-renewal and AP recently:

EAD information:

RD - 05/19/2003
ND - 05/20/2003

AP information:

RD - 05/19/2003
ND - 05/20/2003

I have booked mine and my family tickets to India for July 2nd 2003. If I get my AP before July 2nd I will go on that date otherwise I will postpone it. Buy my wife needs to go due to family reasons.

Myself and My Wife EAD are expiring on 08/04/2003.

I am planning to get my iEAD if mine is not get approved within 90 days. I wanted to know, this 90 days limit includes the holidays or only working days. And my second question is Can I go and collect iEAD for my wife, as she will be in India during that period. She is planning to come back in the second week of September.

2nd Question is If I have an emergency to go to India, will they issue me an EAD before 90 days. Let us say I had to go to India during 1st week of August, only by 18th of August 90 days is getting completed, In case of an emergency Can I go to the local service center (in my case it is San Francisco) and collect my iEAD as I need to enter into this country because I am going to use my AP to enter into the country.

I have one more question regarding EAD renewal.

This time when I have applied for EAD renewal I did the paper work myself. My lawyer was asking me $900 for EAD (for myself, my wife) and Advance Parole for myself, my wife, my two kids.

Just to avoid that expense I have applied my self. I assume that my lawyer might have got hurt because of that. If any RFE comes will it be posted in the "Case Status" page, or I need to wait for my lawyer's call on this.

I am totally confused ... Please advise me.

90 days limits are calendar days not the working days
You can not get iEAD for your wife since they need to get the picture of your wife otherwise also it is not allowed.
If you have an emergency you can get AP but INS may not consider your emergency as an emergency so you need to prove that it is a really an emergency e.g. death of near relation or seriously ill (god forbid that).
For EAD INS does not consider any emergency it is strictly 90 days rule but you can talk to their supervisor not to the idiot sitting on front window.
INS does not issues EAD because you need to enter US on AP. EAD is not required at POE but indeed it helps.

For RFE probably you will get a notice since you have directly applied by your self, your lawyer may not know anything and also don't rely on AVM or online message. They may not be changed in case of RFE.

Do you have last AP approval ? What are the details?
Do you have H1/H4s ?

Right ow I am working using H1-B. But last year when my family went to India, they have used AP to enter into the country. So I assume that, their status got changed and they cannot enter into the country using H4, which is valid till 2004.

Same is the case with me, I have valid H1, but I am afraid to get it re-validated in India, as they may ask lots of papers.

Is there any problem you forsee, in regard my wife entering in to the country without valid EAD. Her EAD expires on August 4th, 2003 and she is planning to enter into the country in September. Right now she is not working anywhere, since she has used AP last year, I assume that she is on EAD. Is that correct?

Last year AP expired on 05/02/2003.
