Hello friends,
My 1st EAD expired 10/26/2005 and I applied for renewal on 08/13/2005 , but still I didn't get the EAD. After completion of 90 days (11/13/2005) , I can get a interim EAD. Is working from 10/27/2005 to 11/13/2005 illeagal ..? I called my lawyer, she told me I can work and it is legal since I applied the before my EAD expires. Is it true...? Any help is appreciated.

Sorry to hear about it, if u have applied to TSC u may had wish to call TSC directly before it get expired.

Its almost 90 days, u may go for interm EAD, hope u already had get infopass appointment.

About EAD expired situation:

What ur attorney said is not true, usually they(USCIS) don't care for that smalll things unless u mention them, so don't worry, it seems your attorney need to renew/endorse his Attorney certificate/License.

Best thing, if u already worked, keep quiet, no discuss with anyone at place u work or anyone else.

Again don't worry , many of ppl I know had same issue , and nothing happened. but if someone is reading this and in same situation should try to avoid any possible headache and shouldn't invite any possible unfortuante.

Good Luck

Thank you POJ. But I aked my employer to remove me from payroll for that period. I don't know whether it's good thing or not.

There should be something wrong with your EAD renewal? Did you certify your mail with return receipt? I renewed the EAD for my wife and she got it back in two weeks.
Find out what's going on with your EAD ASAP!

infopass

I got into this some time back and I went to the local office and got the interim EAD, this was before the 90 days, so get an infopass and try it, nothing to loose. EADs sometimes they take 2 week and sometimes 6 or 8 months, in my case I got an update on my EAD after I got my GC and after almost 9 months. so do not just sit and wait.

Good luck,

I went to local office (Atlanta) even before expiring my EAD, they said I have to wait 90 days. I will again go to local office Monday, I will try fro interim sine 90 days will get over by Monday. if you don't work , you don't need the EAD... right...?

Either you or your lawyer should call TSC immediately. My recent renewal of EAD and parole docs took less than 10 days. It should be your lawyers responsibility. Please be a little more assertive with him. You (or your employer) paid him (or her) to do this.

My Sister-in-Law was in the similar situation and she was already working during the time she didnt have the EAD. Her lawyer told her if the USCIS finds out then they will charge 1000.00 USD as penalty but it wont harm there GC process. There law firm is pretty well known.. Schusterman.. so I think you are safe.. You can choose to take vacation during this time or continue to work thats up to you.
