EAD renewal, worried - please comment

My EAD is expiring this month 01/18/03. My EAD renewal RD is 11/26/02(I am cursing myself for applying for renewal so late).
I am working for the same employer for last three and a half years on HIB i have the H1 renewal till feb 2005. However ever since I got my EAD last feb 2002 I have been doing some extra partime jobs on weekends and week day nights and also recently I entered US on my advance parole and my I-94 says "Parolee".
This puts me in parolee or adjustee status eventhough I have h1b renewal till feb 2005 and I continue to work for my h1b employer full time.

How can I solve this problem once my EAD expires end of next week .
1. Can I send in another H1B renewal ASAP to get back to H1 status.
2. I dont think I can stop working for my H1b employer.Does any part of the law allow me to continue to work till I get my EAD renewed.

if your EAD expires , you should able to work on existing H1.
That's what my lawyer adviced me.


Let's hope that you will get your EAD before H1 expires.

EAD renewed

Mine and my wife's EAD had the same expiry date : 01/18/03.

We applied for EAD renewal with the following details:

RD - 11/26/02
ND - 12/03/02
AD - 01/09/03 (Checked online at INS web site)

We are still waiting for the cards.

You should be getting your approval in a day or two.

I am in the same situation...

You can work with your H1 job. However I would advise you to stop all other work until the EAD card comes into your hand. It may mean a few dollars less, but with the resumption of INS approvals, it's worth it....

I will ask my employer to file another H1b renewal petition next week just to be on safer side and will continue to work for my H1B
employer. I have stopped moonlighting till I get my renewed EAD card.

this H1b/EAD /AP issues are a gray area of immigration laws,depending on who you talk to there are different opinions about this issue.

for 485GCcase I think at this rate I will have esophago-gastro-deuodenal ulcer!
 
EAD => H1 !!

My understanding is once EAD is used, one will lose H (H1 & H4) status. Not sure if reverting to H1 status while AOS is pending is possible. May be your attorney may have exact solution??
