EAD Renewal VSC - extreme help needed !!

My own brother's EAD / Advance Parole / H1 are expiring on Nov 16th of this year. Need advice on how to proceed now from either the attorney's or our member gurus .

1) Does he need to extend the H1

OR

2) Can he just extend his ead and still stay as a legal resident with out H1 extension ?

3) If he does not have H1 and just extended ead, if he has to go to India how will the advance parole work ? will it still be valid as before or any special care needed ?

4) Finally is there a preset time limit , like 90 days before expiry that the renewal must be done ? Or can it be done just before these things expire ?

------If is he still working on H1 and not switched to EAD, H1 can be extended.

OR

2) Can he just extend his ead and still stay as a legal resident with out H1 extension ?
-- Since he has filed 485, his status is legal.But for working either EAD or H1 is required.Even if he applies EAD now, and he doesn't get EAD before(November 16th), he can not legally work on EAD.For getting interim EAD, he should wait atleast 90 days from the date of EAD renewal Receipt Date.Where as if he applies H1 extension, he can continuing working without any gap.

-----AP will be valid till November 16th in this case.If he wants to come back after November 16th, he need to apply for another AP.

also one more question his I 94 expires on Oct 29th of this year.. will that need be extended too ? Or since he has valid H1 until mid nov ...is he ok without extension of I 94 ?

since he has valid H1 he should be fine.. and H1 itself has a I-94 at the bottom. But still since his I-485 is pending he will be in legal status..
