EAD renewal question.

Hi,

I am renewing my EAD card. ( it expire on 12/18/02). Currently i am working on EAD with no H1B.
During I485 process, I applied EAD for my wife also.
She is not working but she has EAD. Should i renew it or not. If i won't renew, what would be her status. Does she comes under H4 even if i am working on EAD.

Any help will be appreciated.

Depends...

If your wife has no plans to work, then she needs no EAD.
Once u r on EAD, Current H1 is automatically of no use.But Some sites say, if H1 is still valid, then one can use H1 even after using EAD which is coming back to H1.

Once u r on EAD, it means u r not on H1, which implies H4 is also not valid.

As long as I485 is pending u r legal. If you want ur wife to work, she must renew EAD else nothing to do.

Just now, i got information from my lawyer also. She will become AOS status. I won't renew her EAD.
