EAD Renewal: Is it a must?????

Guys, Please advise.

My and wife's EAD expire 11/11/02. I'm currently on EAD. My wife is a homemaker.

I plan to extend for myself on lawyer's insistence (RD:8/9, ND:9/28).

Lawyer's fees being quite high ($300+ application fee), and since my wife doesn't plan to work anytime sooner in near future, is it alright if I she doesn't renew her EAD?
Or is it a legal requirement for her also to renew regardless?
 
It is ok not to apply EAD for your wife. There is no legal requirement that she must have an EAD. Only problem is if she wants to work after the expiration of the EAD, she will not be able to until she applies and gets an EAD - that is considering your don't get your GC by then. If she doesn't plan on working anyway, don't bother. By virtue of having an I-485 application and a receipt associated with that application, she is in legal status even without the EAD. In anycase, you seem to be pretty close to getting your case approved :) . Good luck.

Sounds like your lawyer wants to make more money from you :)

I don't see a need for you to renew your EAD right now. (You definitely don't want to pay the lawyer to renew your wife's EAD) I would wait for another month or so to see what's going to happen to your case -- My guess is that it will be approved any time soon -- absolutely before the expiration date of your EAD(11/11/02). It is very hard to imagine a VSC RD 8/9 case not approved by then.

Of course it's up to you... I AM NOT A LAWYER!

My concern is I plan to be out of country from 8/19 and back 9/9. If I don't apply before leaving, and in of case of RFE getting issued, I don't know if it will be too late by that time to apply.

1. 300.00 plus application is too high, Negotiate with your lawyer.

2. If your wife is not working no need to renew her EAD.

3. If you are gonna be out of the country till late sep 2002, I would sincerely advise you to renew your EAD. Even if you get approved before your EAD expires, Think of it as an Insurance.

Like I said on an earlier thread "Think of it as an Investment"

1. Unless your employer is going to pay, you can apply the renew yourself ($120 application fee, I think?).

2. I would still wait for another couple of weeks (before leaving the country) to apply. I assume that you will have somebody watch for your mailbox anyway ( for possible RFE. right?).
