EAD Renewal / Biometrics problem!

I have also been posting on the EAD Timeline thread, but my case seems to be getting more complicated.

My current EAD expires on 12/10/05. I applied for the renewal of EAD on 9/1/05. NBC sent me the Biometrics notice for this renewal in the mail with the appointment date of 12/08/05, which is only 2 days before the current EAD expires. So I think if I did my biometrics on 12/08/05, I will definitely not get the EAD card before 12/10/05.

I called the 1-800 (Customer Service) Number, but the lady said that if USCIS / NBC has sent a biometrics appointment letter by mail, you cant change in over the phone. So as a last resort I went to the ASC and talked first to the security person and then to the immigration officer at that center, both said they couldnt let me complete the Biometrics on the day I went because of large number of people there, which was true.

So I urged the officer to consider my case where I basically was sent the appointment date of more than 90 days after my receipt date for EAD. My Receipt date is 9/1/05 and biometrics appointment is on 12/08/05. On that she said that as long as I have the Biometrics Stamp on my Appointment Letter on 12/08/05, which will be done before my current EAD expires on 12/10/2005, then I should be good to continue working, as I am then only waiting for the card in the mail to come to me.

This was told by the officer and not the security person, so that makes it genuine, and from the way she talked, I dont think she was just trying to get rid of me out of the center, so I have reason to believe her.

But I just wanted an opinion from you guys on what you think of that statement. I have never before come across such a thing that if your EAD Renewal is held up only because of Biometrics, then you are good to keep working as long as you have received a stamp on the renewal application that the Biomertics were done before current EAD expired. She said i could use that stamp as proof that I have done the biometrics on 12/08/05 and that I am just waiting for the new card in mail which usually comes within 2-3 weeks.

I would greatly appreciate your advice on this, as I am stressed out with the current appointment date that I have been assigned, which will put everything in jeapordy for me.

This is where Interim EAD would come into picture. You can get one if your EAD renewal does not happen within 90 days and your current EAD expires.

Yes I would certainly hope I can get an iead on the 91st day of my EAD receipt day. But on doing some research on this portal and a couple of others, it seems that its probably going to be more complicated than that.

Many users in the same boat as me on another site have reported that the Immigration Officer at the District Office has told them that you cant get an iEAD without the Biometrics on file. Since these 2 things (iEad and Biometrics) are handled at 2 different buildings, it becomes a blame game, the Biomertics people say they cant do that because NBC now schedules the appointments and you have to come with the letter, and at the DO, the officer says that he cant give an IEAD because there are no biometrics done. they dont care for the 90 days, all they look for is the letter and that the biometrics are done before they will issue IEAD or issue the actual card. In some cases, they also have been told that the IEAD cannot be given becasue their EAD has been "Approved", but not issued becasue of Biometrics. But it will vary from DO to DO and ASC to ASC. So some of us lucky folks will be getting it, some unlucky ones will be the victims :(

Everyone has been reporting that this new system by NBC to schedule the Biometrics appointments has been delaying the EAD issuance by atleast 30 days. From around July 26th onwards (?), they have shifted to this new system, no more calling in the 1-800 number to schedule appointments, everyone will get a letter saying that they should wait for another notice for Biometrics, which obvioulsy delays the process instead of speeding it. Most of the CSRs on the phone as well as at the ASC have been asked to not let the Biometrics done without the letter. Ofcourse your luck may vary, but this is where this is going....

Lesson Learnt: Yes, now you have to change the mindset that you are going to be renewing EAD every 6 months instead of a year :p Just doesnt make any sense, its a waste of time and money! Many users including myself have been sending in renewals 3-4 months before the expiration date thinking that it takes 60-90 days to get one, but with this new biometrics scheduling, I wont be surprised if it will be 4-5 months on average to get a new or rewenal of EAD, which means what - 7 months into your EAD, and you have to shelve out another $175 to get a new one :mad:
