hi All,

If your I-485 has been pending for more than 180 days and you happen to use AC21 to move to a new employer and if your old employer revokes your I-140... what is the impact on EAD renewals in the future.

Do we have to file the paper work for AC21 before we apply for EAD renewal... i am asking this question beacause when BCIS approves for EAD they seem to check if I-140 is valid...

Can you please throw some light on this issue...

Thanks,

EAD is based on 485 and not on 140. However 485 is based on 140. When you apply for EAD renewal they check if you have valid 485 pending. 485 stays pending till 140 is approved/pending/not revoked.
But if 140 is approved and 485 is pending more than 180 days the employer can not revoke 140.
AC21 application is optional itself and there is no prescribed time frame for it. EAD has nothing to do with AC21.
You can also check the
AC21 Forum for other details
