EAD renewal after letting it expire

Hi all,

My current immigration is thus:
- I'm on H-1 visa, wife on H-4
- Permanent residency application is in AOS phase, LC and I-140 stages completed. I have EAD and AP as of 2007 when my priority date became current.
- My wife does not have either EAD or AP as priority date regressed and we got married in 2008.

My company has informed me that they will no longer pay for EAD renewal as they are also paying for H-1 renewal. My question is this - if I decide to let the EAD expire now will I be able to renew it some time later (say in a couple of years) even if my priority date is not current at that time?

Any information will be greatly appreciated. Thanks!

EAD has nothing to do with priority dates of validity of previous EADs. It is granted as a privilege for anybody who has a pending I-485, if the alien wants to work and doesn't have an underlying non-immigrant status.

Yes, you can get a new EAD at any time (as long as your I-485 is still pending) regardless of the expiration of a previous one. Again, your priority date is not relevant here.
