OK Folks,

If you have filed the application to renew the EAD and got the receipt from INS than do not worry about getting the new EAD on time.

You are fine as long as you have a receipt notice from INS for new EAD.

This is advised by my lawyer.

So stop worrying....
 
Thats not true

You should have the actual card with you to start working on EAD unlike the H1 where you can work while H1 is in processing.
 
This is a pretty tricky issue. I think this judgement based on the following:
1. EADs almost never get denied - especially renewals.
2. Companies are willing to "postpone" renewal of I-9 if they are assured that EAD will be issued
3. EAD renewal authorizes employment on the next day after your previuos one expires.

Based on all this, if EAD was issued a month later after your current one expired, it is assumed that the new EAD basically retrospectively authoriuzes that last month of employment.
I'm not aware of any INS memos that would actually confirm that - than again, I could be wrong - so you would be stepping into a gray area here. As a general rule, gray areas should be avoided... Situation with H1-B is quite different - from what I have heard, H1-B holders are explicitly allowed to work while their revalidation is pending...

How can you say this is not true ?
You need EAD if you are starting a new job or changing a job, In case of a continued employment you can always show a recept notice for EAD renew application and a note from your lawyer...
( If somebody ask you to show EAD again..)
