EAD question

Hi,
I have a friend of mine working on his EAD and filed her 3rd EAD renewal on 10/29/2003 but as usual no approval yet.
She is getting pay every other week. Her employer owing her 40 hours from last week work.
To keep her insurance going she have to get paid. Her HR department suggested instead of paying her for the 40 hrs from last week, they will pay her 10 hrs/week or so till she get either EAD card or IEAD which by any case shouldn't be exceed 01/27/2004.

Is that legal????

Technically you cannot work without an EAD or even with an EAD receipt. But some companies do accomodate such things. There are many ways of doing this also. One of the ways is not to pay till the EAD is approved and pay the whole amount after the approval.
