EAD Question

Hi guys,

I need to change from H1B to EAD with my company. However, the company does not know what paper work to do. Does anybody know the procedure? Could you share this information? Thanks in advance.

Fill out I765 (Employment Authorization Document)
Submit the form with
$120 Fees
2 ADIT photographs
Copy of I485 Receipt Notice
Latest I94 Copy and that's it.

After approval, when u switch from H1 to EAD, company has to file I-9 to switch ur work status from H1 to EAD

That's it..!
 
Thank you for your reply. Sorry that I forgot to write that I have EAD now and the company just need some paper work to change my status.

As vijayrc said, ask your company to file I-9 to switch your work status from H1 to EAD.

Your completed I-9 along with copies of your EAD and driver's license/passport are kept in the company files and not submitted to anyone.
 
As far as I know I-9 is internal document for company and they may be required to furnish to BCIS if they are asked to, but I guess filing the I-9 is a complete mis-information, you don't have to 'FILE' as I-9 like EAD etc.

Just verify with your attorney....

If I-9 is not required to send to BCIS unless being asked to. How does BCIS know if one is working on EAD/H1/L1 ?
 
Please clear this with the attorney all I know is that it is part of good faith that employer is having a legal person, H1/L1/EAD etc are filed but I-9 is not filed as unlike others, they are kept as local records for the company
 
Maintaining I-9 for each employee is the responsibility of the company. I-9 tells that the company is not employing any illegal immigrants. BCIS as part of their audit may ask for additional details from the company at which time the company needs these details of I-9.

The only thing I always wonder is How does so many illegal immigrants find jobs in US.

It means they are not filing I-9 with the company.

If they do not sign I-9 , technically they are not on payroll.

If they are not on payroll , how does the company account the salaries paid ??

Does the Employee (illegal immigrant) pay any taxes with IRS ? I don't think so as the employee will not have a W2 ..

They don't pay any taxes and still get citizenships.

While we are probably the ones who are contributing the highest of taxes and yet struggling for GC...

'File' has two meanings, you can 'file' to external auditor like BCIS or 'file' internally to have the record. So there was no mis-information given.
