EAD Question

I would appreciate your insights on the following situation:

I was wondering if it would raise eye-browse at the INS if I apply for an EAD without going through my company lawyer and regardless of my H1B visa which is still valid until end of next year. The reason I am asking is that our company started to lay off people and I just want to be save to have an EAD card so that I can work for another company in case I get laid off too. Assuming the following scenario: I get laid off, but find a new job soon after, but don't have an EAD - do I have to wait until my H1B gets transfered to the new company before I can start to work there or should I apply now for an EAD so that I don't need the H1B tranfer but can simply work under the EAD? I hope that all this is no issue anyhow, but I want to be prepared for each and every eventuality.

Also, if asked, could I simply say I would like the EAD so that I can start a small business on the side or work a second job (for a few hours per week)?
