EAD Question

Hi Everyone,

Compliments of the season to everyone. I just became a US Citizen last week and also just applied for my spouse I-485 & I-765. The question is how soon should i expect to receive her EAD card. I have an approved I-130 since August 2005. My DO is NY City. I know the timeline for EAD is between 75-90 days for NYC. Should i expect it sooner because i have an approved I-130 since last year august or otherwise.

Any help will be appreciated.

Thank you.

Sometimes it takes more than 90 days, like in my case.

I have not received the EAD yet, even though AOS interview was fine, but pending on namecheck.

I am going for an infopass appointment, but ppl tell me that DO can't issue the interim EAD even after 90 days. But my attorney has asked me to go anyways, to push the process.

Will let u know what happens

The EAD is a benefit available to AOS applicants, hence I would think the approved I-130 per se won't speed up the processing time. It is possible I guess, since it's one less form they need to process, but don't get overly optimistic. I would realistically assume about 90 days, provided everything goes smoothly without any RFE's.

Hi:

Unfortunately the I130 should not make much of a difference. The EAD is really based on your I485 application. Best of luck.

So I went to the DO for infopass, and they told me that the EAD is approved pending on biometrics, which they don't have !!!!

Apparently they didnt have the biometrics that I gave in Oct. So I went for another Biometrics nearby. Hopefully it would expedite the process.

If you're filing AOS then EADs are processed at the National Benefits Center (AKA Missouri Service Center), not at your DO so the time is 75-90 days no matter where you are in the USA. There isn't any way of expediting this, and your approved I-130 won't make any difference.
