Me and my wife are on H1-B right now. I filed my 140/485 concurrently in December 2004, along with 485/EAD/AP for my wife. I decided to stay on H1 therefore did not file for EAD for myself.
Now my wife's EAD has been approved and she's planning to accept a permanent position on EAD. So what happens if something goes screwy with my 140? Can she change her status back to H1 in that case? Would she be subject to the H1 cap at that point?
