EAD Question

Hi ALL,

I am working on EAD. My EAD is expiring on Jan 24th.
My RD for 3rd EAD is NOV 19th, all I have from BCIS, is the notification document.

My question to all of you:

If my company HR does not ask for new EAD, is it legal for me to keep working and just keep quiet till I get my EAD approved.
Do you guys think EAD Notification is a legal document to convince teh company, if they ask, that my EAD process is on and I should be hearing soon from BCIS.

Please do advise.

You must have a valid EAD to work- if not in hand at least approved. Just applying for it does not enable you to work. Rest is upto you and your HR.

Tell me, what if my HR does not ask me, and lets say I get my EAD approved by Feb 1st week.

Will there be any legal issues with it later on. In any processing, whether its GC or citizenship etc.
 
EAD

If you are on H1 and it is valid you should be OK.

All I have heard is that the company would be in trouble if you worked on unapproved EAD.

You go on vaccation till your EAD is approved.

The only way you can get into troble is if your case is transferred to a local offfice and during the interview you have to prove that you where in status all the time.

Some local offices give out IEAD even to people who are out of there juristiction. You can try going there; eg vermont. See other messages on this board for details.
 
Hi Everyone,

I went to INS local office in Arlington, VA.
My EAD is expiring tomorrow and I don't have the new approved one.

The officer told that its absolutely legal for you to continiue to work till you get your EAD approval. If your company is very particular about EAD expiration, and if you lose job because of this reason, then they can issue a letter to the employer. But they won't issue an interim EAD till 90 days are over.
