EAD question,please help

Hi,

My wife's EAD is expiring on Nov 25th. If I need to apply for her EAD renewal before 90 days,I would have to apply with in 10 days. I spoke to my attorney. He is going to charge me $175 + $120. My EAD is expiring on 1/6/2003(had RFE for photos, hence i got it till 1/6/03). For me also he is going to charge 175+120 later.

Is it true, even for EAD renewal the attorenys are charging so much?

with 20% pay cut, it is difficult for me to pay $550 again.

My question here is, does my wife need an EAD renewal?. She is not working for now and with the current job market ,we do not know when she is going to start!

When she is not working, staying with an expired EAD is out of status?

If I need to go for EAD renewal, can I do it on my own? what are the risks?

any suggestion is appreciated.

If your wife is not working, you dont need to renew her EAD. She will still be in status, but she will not be able to work.

You can wait till 2 months before your EAD expires to be on a safer side then apply for renewal (hopefully before that you should be approved)

Lawyers fees Differ from lawyer to lawyer, yes you can apply on your own, its not a big deal, but my advise is if he is handling your I485 case also dont antagonise him, think of it as an Insurance.

Bottom line is at this time you dont have to worry about anything,
1- your wife is not working
2- you still have till atleast Nov to file for renewal.

So go out and spend that 550.00 on Jewellery for your Better Half
:D

EAD Renewal

I don't think you will antagonize your attorney by renewing it yourself. Why tell him in the first place? Just go ahead and renew it on your own.

I am planning to renew mine and my wife's myself when the time comes. I need to do it in September as ours expire in Jan'03.

Thanks

Renewal

If your wife is not going to work don't waste money. She will remain in status till the I-485 is abjudicated. The EAD is for work only and has no bearing on her status. Whenever you do feel like renewing it do it yourself. Why pay the lawyer for something you can do yourself.

Thank you all for your valuable suggestions.

For some time I felt like ,I am all alone. Now I have all of you.

In this troubled market, every thing looks like a big issue to me.

Thanks once again

Some more.............

My lawyer filed for only my EAD (11/11, RD:8/9/01) renewal yesterday despite his insistence on doing it for spouse as well. Thr lawyer also wanted to do AP for three of us and I refused saying we will not be travelling when AP expires (~10/31).

My company is paying for all this but still I didn't want to pay for those document renewals which we won't need.

BTW, for one renewal, lawyer fee: $250+App. Fee +Costs ($50). I wrangled out the "cost" part out of the lawyer because I made him agree that $250 should cover that. Anyways, the form that he sent me for signing (I765) had my wrong A# (so much for $250 fee).

All said, go ahead and do it urself. That is cheap and best.

I applied for EAD Renewal

Hey I applid for renewal of EAD myself and it was so easy. Just paid INS fees of 120 myself and my wife. Don't waste money so do it yourself.

I485 receipt is the evidence of the status. EAD is just to work. As long is your wife not working spending money on EAD is waste. Also you can go to some INS offices to get EAD renewed. Check with your lawer for this option. Then you can wait till one month before the EAD expires, you may have your GC approval by then.

Thank you all for your suggestions once again.

mmangu,

What is the procedure? I mean documents etc? Please give me the list if you have it handy.

We went to India on AP. I guess I would have to attach the new I-94 copy , stamped AP copy etc.

Also, do we have to get the copies of all the documents notarized? As attorney files it, we do not know all the details.
When I am filing by myself I have to make sure everything is OK.

thanks

I Applied with the following documents:

1. I 765
2. copy of latest 1-94
3. 2 photos
4. Drivers licience
5. Check for 120$
6. Attestation letter saying all documents are tru copies
7. Signature Card (I earlier read in this forum that this is not required)

Hope this helps

Good luck

Sorry also forgot to mention. There is no need to notarize. I did not do it. I spoke to my lawyer he said not required.

mmangu,

What is letter of attestation?

also, please answer, why do they need driver's license? is it really required. I do not have problem of sending it. But are there any other docs to be attached?

Where do we get the full list of documents?

thanks
