Hi y'all and happy new year,
First of all sorry if this has been answered already,
Can i go to local INS office and apply for EAD or I have to send it to Nebraska?
I know asyless are no longer required to apply for I-765.
I wouldn't be renewing it if it wasn't for a good prospective job.
I appreciate your answers.

thanks

You have to apppy thru Nebraksa. And it takes about four months to receive it.

And it is pretty dumb to apply for that document. I do not know what kind of employer you are talking about, but federal law requires them to accept a photo ID and your social security card. If they refuse, call the civil rights division of the Justice Department.

Thanks Gilbert, allright, i am gona get the civil rights division of the Justice Department phone number and have it handy in case they ask.

thanks a lot

Hi Cider:
I applied for EAD on Sept. 15th and got approved on (Yesterday) Dec. 31st. which was the best news for me as I have been waiting for that. Usually it used to take 1-2 months but now they are taking more time. You have to apply to NSC. However you can file it electronically to expedite the processing and go to your local INS office for your picture and electronic signature. That what I did this time. I did not do any paperwork. I filled application on line and sent it. Then went to locale INS where they took my picture, fingerprint, and signature and transmitted rightaway. This help in expediting the processing as your application will be there same day into their system. You will save time in mailing, and no one has to enter you manually.

Any news on I-485? I hope they move little faster this year.

Happy New Year!

thanks Azadindian for the info, I decided not to apply for EAD this time. As for the I-485, nothing yet, the good news is, we know they are processing people with ND post 11/16/99. It might be a little slower, but there is nothing we can do.

Some HR people in private companies are REALLY immigration policy illiterates. To make things worse I-9 or whatever form you have to fill out for employment gives you options regarding your immigration status: Citizen, LPR, and non-immigrant alien. There is no special option for Asylee/Refugee. And because there are stiff penalties for hiring immigrants who are not authorized to work they tend to a little overact when it comes to verifying your immigration status and employment authorization. It may seem to us that it's a form of showing discrimination but from their point of view they are affraid of being fined by the INS.
Gilbert is correct, strictly speaking they can only ask for photo ID and SS Card. A good HR person who understands INS employment policy knows that if the job applicants' SS card doesn't have any employment restriction notices printed on it there is no need to ask for additional documents etc. But if one's SS card bears the notice "INS authorization required for employment" then I think the HR person can ask for EAD.

In my opinion , and speaking from my own experiences, I would try to show them the letter from Health and Human services saying Asylees are authorized to work without EAD before I make any complaints with DOJ. I would only complain if the employer still insists on seeing your EAD after you showed them the letter.

And if the employer has no pervious experience in hiring asylee/refugees then they might also wanna know how your status is different from LPR green card holders etc. I've been through those experiences b4 I got my green card. You have to be patient with some HR people: some of them REALLY don't know about these things. Some of nice HR folks usually shy away from asking you these questions regarding your immigration status but nonetheless they have to do their job.
