Let me begin by appreciating that this is a great forum and I have learned a lot from you all guys; u all deserve a big thank you...
I am currently in process of concurrently filing 1-140 and 1-485 for VSC (NIW)...I have few questions on that:
My current J-1 visa is expiring at end of March...I am considering to apply for an H1 for after that because job is only for 6 months...
My question on this is: Will it make my NIW case strong if I have H1 before
I file the NIW petition rather than J1?
I checked a lawyer's website and it says that EADs received by VSC on
12/22/2004 were approved on 01/11/2005 (~20 days), while on USCIS webpage, they are currently processing EAD filed ~15Nov 2004 for VSC...
I wanna ask you, from your experiences, how long does EAD normally takes to arrive if there are no technical glitches compared with 90-day worst case scenario?
In summary, if I can expect to get EAD soon (~30 days) and if having the H1
during time of filing of NIW application does not significantly help, then I
would rather not pursue an H1 for time being cuz I gotta pay for H1 fees?
Any thoughts, insights, comments will be greatly appreciated!
