0ct 2002 Receipt Date for I-485 EB2 Category at Vermont Service Center. I was in TX , Filing done by Attorney.
Received EAD(I-765) on Nov 19 2002.
Informed USCIS of address change to Los Angeles, CA.
Worked on H1 untill Aug 31 2003.
I applied for EAD(I-765) renewal in Aug 2003, received renewal untill Nov 2004.
Started working for sponsoring company from 1st Sep 2003 untill 11 Dec 2003.
Took up employment with another company using EAD(I-765) in Dec 2003.
Informed USCIS of address change to San Jose, CA.
I applied for EAD(I-765) renewal in Aug 2004. receipt date 24 August 2004.
Informed USCIS of address change to Omaha, NE on Sept 6th. VSC transferred all my paperwork to SanFrancisco local office.
Did not receive EAD(I-765) renewal untill 30 Nov 2004. Omaha local office gave me temporary EAD(I-765) for 90 dyas.
I wrote couple of letters to SFO office regarding processing my EAD(I-765), finally the sent me a letter(dated 31 jan 2005) stating that they forwarded all my paperwork to Omaha.
I went to the Omaha local office on 3rd March 2005 to get my EAD(I-765). I was informed that my paperwork has been received but they cannot issue me a EAD(I-765) as they have denied my EAD(I-765) on 12/29/04. I told the Immigration Officer that I have not received the denial notice. She asked me to contact my Attorney. My Attorney who filed my I-485 has not received any notices.
I called the USCIS Customer Service, they told me that they are not responsible for postal delays missing mail, the usual time for appeal is 30 days and I cannot appeal as it is past due. She said my only option is refile I-765.
My online status still say that they have transferred my case to SFO local office. I did not file AC21.
Gurus what are my options ?
