What are alternatives for a person who is on EAD (EB3, FP Biometric done), 3 years of H1B remaining & he gets laid off?

Will he be in legal status? Can he stay in the country and look for job or thats the end of immigration journey.

Hi,

I do not think this is the end of your immigration. Remember that Green Card is for the future job and it is on the basis you got your I-140 approved.

I think all you need to do is to find a similar job described in I-140 and can invoke AC21 with the former employer and work with a new one.

In case of any RFE's on your I-485, you can show your current employment status and the job description.

This is what I understand from many in the forum. You need to consult with an immigration attorney, who can be more specific with your case.
