hi All,

1. my EAD is expiring 4/4/03 and I was only able to reapply for renewal by 1/24 or so. So looks like if I go by the 90 day rule, I cant ask INS for a new iEAD until 4/24 or later.

2. Lawyer sent the application on 1/24 - but hasnt received the receipt till date - so Ive no idea if INS has received it or not. If I am to go to claim my iEAD after 90 days, what do I need to show INS & if I still dont have receipt by then, what can I do about it?

Since this is a renewal, is there anything I can do to get the new EAD as the first one expires?? Also, if I work on the EAD, what happens during the period in between two EADs? any opinions or solutions? Am I going to be out of a job? or can I "plead" with INS on this issue in any way to renew without the 90 day wait period?

From my experience that I postedtoday, Probably you are doomed if reciept <90 days. Please read what I have to say...

You can ask, they will not eat you alive and perhaps may give iEAD

You need some proof of submitting renewal EAD. It's strange about recept, may be your lawyer didn't submit all documents and INS will return you application

You will need take unpaid leave, but if your HR will agree perhaps you may work without EAD using 245(i) (if you are meet 245(i) requirments)

Well , according to my lawyer if you r working for the same
company u dont need a renewal. Anyways u have applied for
renewal (and so have I ) So u r perfectly legal and IN Status. U
need renewed EAD to change jobs (i think) but for the same firm
u r fine.
I read on the Borad sometime back that someone got
temp EAD before 90 days as it was in renwal process. If your
company is cool and they dont object, then u dont need to rush for I-EAD. When ur renewal comes in, the EAD will be back dated to the day urs got expired.

You are definitely NOT chewed! I am sorry but I guess in the celebration that has been going on in this forum over the approvals starting to flow in, your post got lost somewhere.

You are definitely in status, it is too long to go in details but if you just search over the last month's threads you will find a couple of threads where this issue has been hashed and rehashed a hundred times over.

To summarize the threads, as minknowledge1, renewal EAD's are always post dated and are valid from the time the original EAD expired, so you are always legal to work once you apply for it. As long as you have not changed companies in the interval.

Same boat, but was asked to go to TJ to get H1

I am in the same boat only worse than yours.

My EAD expired in 3/24/03. Renewal was submitted one week ago. It is not likely I will get renewal in time.

No change of job for me. HR told me I need to travel to Mexico to get a new H1. I don't want to go since the price is too high if I don't get approved in Mexico, then I have to fly home. The employer wants me to go since they want me to continue to work full time.

How can I keep working full time while 485 is pending and EAD renew is pending?
 
check with your lawyer if the money has been withdrawan from the bank by INS. INS puts the wac number of application on the back of cheque which u send them. If the money has been withdrawn then get a copy of cheque and find out ur WAC number for EAD then u can get iEAD easily.
Second if its not been cashed then i guess ur lawyer screwd up somewhere so send a new app own ur own and u will definately get the recipt.

I am sure you will get your receipt notice pretty soon. My attorney filed my EAD and AP renewal applications on Dec 5, 2002 and got the receipt notices on Jan 28, 2003 with notice date Jan6, 2003. Guess what....by that time my AP got approved and got the approved AP on Jan 29, 2003 :-) My AP was approved on Jan 9. BTW, as ghost-rider said, its better to see if they have cashed the check. In my case, the check was not cashed even as late as Jan 7.

you made me feel better...I will chk out the info you guys gave...I will probably try to give a pre-90 days iEAD a shot...
 
Time to apply 2nd EAD

I don't know why we are missing dates to apply 2nd EAD. we all know that now a days getting approval in time is not possible, so why to take chance or why to assume that I might get GC by that time so why to apply EAD, or let me wait for some more time.

I will post a new thread just to remind ppl.

for one thing...I guess I got simply too busy at work that all this didnt strike me...I checked but was late by abt 4 days - and you know how it goes - even if you send it in - delays occur along the way...

After this scare, I have set up alerts for all my vital documents - driving license, passport etc...
