EAD issue

Hi there,

My I-140, I-485 (Adjustment of Status), EAD-application was filed through company A in April 2004. In June 2004, I left company A and joined company B. Recently, I have received my EAD card and also received a finger-printing notice from INS. Still my I-140 and I-485 are not approved. I want to know:

- How good is the EAD without I-140 and I-485 approved. What I can use it for?
- Is it possible for my previous employer (company A) to withdraw I-140/485 application? In that case, what will be the consequences? Will my EAD be still valid?
- Is it advisable to start my whole Green-card process starting from labor-certification with company B? What will be the pros and cons of that approach?

I am novice in this field. I'll really appreciate anyone who can shed some light on this issue.

My opinion is that it was a bad move on your part to leave Co. A so soon. Offically you have to wait 180 days after filing your 485 before you can legally change employers.

1-I believe your EAD is valid for the duration of the card itself. (Although you have illegally changed jobs in my opinion). You might want to double check this.
2-Yes it is very possible that Co. A will withdraw your 140/485 application.
3-That's why it was a bad decision to leave - I don't know if you would need to start the process again - but my gut feeling is YES.

Even if you wait for 180 days what difference does it make.
My I140 was files on April 04 2003 still pending,All attempts i did to expedite processing.Recently i had purchased a home also and all saving money is sunk in new house.House had mould issue.So i can not sell house before fixing it.

Employer is closing the company wef 31 July 2004.Dont know what to say INS they dont understand.People get I140 in week also.Very sad.Some time you just dont have choice.It is part of life for some people it is good for some it is bad.
