EAD Issue Please Help

As per AVM both mine and my wife\'s EAD got approved on October 25th. I got my EAD card on October 31st. We still didnt receive my wife\'s. When she called INS and talked to someone couple of times, she was told they dont have it in the undeliverables. So asked her to go and find out in the local post office or else apply for a new card again. They told they cant issue a replacement as they already sent one. Did anyone had the same kind of situation. We need someone\'s advice very very much.

Usually you can file INS form I-824 to request a duplicate of a lost or misdelivered approval notice of any petition. I do not know if this applies to an EAD plastic card.

Thanks for the advice BOYOHIO. I was thinking the same. But the thing is my wife is already on H1 thru an Atlanta based company since the last 8 months. But she is not into payroll yet. We are living in Detroit. Does these have any detrimental effects if we go to the local INS office. She has got a job lined up here and we are waiting for EAD as they didnt want to file a H1 tranfer. Please advice about this.

Thanks. I didnt know about I-824. I wrote to my attorney and will wait what he says.

your wife is OOS - it happens to me too; My wife was on H4 and then H1B but no payroll; so when I filed her 485 I had to pay $1000 fine under 245(i) as she was being technically out of status; contact Attorney to avoid further issues and get her back on H4
