EAD in California

I just saw the following post in one of the forums. Can anyone who has filed I-140/485/EAD/AP in California please tell their experience?

I am not sure about the other BCIS Service centers, but CSC has made it clear that they will not issue EAD untill the I-140 is approved.


Concurrent Filings

Applications for Advance Parole and Employment Authorization (EAD) will not be adjudicated until the underlying Employment Based Visa Petition (I-140) is approved. However, if the EAD application is pending for more than 90 days and no Request for Evidence (RFE) has been issued on the underlying I-140 OR a response to an RFE has been filed more than 90 days, the individual may go to the local BCIS office to apply for an interim EAD card.

I concurrently filed my I-140 and I-485 in July in California. Advance parole and EAD arrived a week or two ago.

Would have been nice if the EAD had the country of birth as Australia instead of FRENCH POLYNESIA!

what is your receipt date in July? Did you get your EAD, AP after exactly 3 months? Is your 140 approved?

In sept '03 I filed (concurrent) 140,485,ead,ap in EB2. i got RD,ND in a week.

how long does it take in California to get AP, EAD? Does anyone know why 140s aren't moving at all in CSC? Are they stalled just like labor two years ago?

can i go out of company after 6 months if i don't get any RFE on 140?

Sept 03, my friend, There is a long wait ahead. My Rd is 01/17/2003. Havent gotten rfe nor approval for nither of them.

The dates do look stalled. Looks like I140 is lowest on their priority list right now.

No, I140 approval is a must for you to be able to move on. It is 6 months since I485 RD, given I140 is approved and you have EAD

Legally you can work for any one once you have EAD. So you can change job after I-485 pending 180 days while I-140 pending. Please note to do so, you need your I-140 sponsor company fully support you case even after you left company. Practically for most people it is better to wait till I-140 approval.

all my documents as dependent were submitted in February.
I went to the local service center to get the iEAD while principal's applicant's I140 was pending and I got it. But that was in June, and only after the principal applicant had submitted RFE to BCIS and they had received it.
The original EAD is still pending, lawyer said I've just received RFE (marriage certificate copy lost by BCIS), and I haven't checked the Web site yet.
