My EAD has expired on Jan 9th. IIO said on Friday that my EAD renewal was approved on Dec 28th and it takes about 2-3 weeks for cards. However the AVM still is unchanged. My lawyer says that I should go to Newark and get it since it has been more than 90 days since filing. My take on that is, since my emplyer has no problems with it, I should wait for the card to arrive in mail. I do want to check it some of you who might have a strong opinion one way or the other. Please let me know what you think.

Details : EB3/India, I-485-ND : Oct/27/99, No FP.

Thanks,

My EAD expired sometime in Oct. Renewal was approved 3 days after the previous expiry. My employer did not have problem letting me work without the actual card because, I have been working on EAD and my renewal was approved according to IIO. So I worked while waiting for the card. The card arrived few days ago and it has been renewed starting next day after the expiry of previous card.

Kiran,

Thanks for the info. So you waited almost 2-3 months for your actual card to arrive. My attorney was probably trying to scare me that my employer may have problems with not having the card in hand eventhough it has been approved.

Also, do you remember if your AVM changed during this gap (2-3 months)?

Thansk,

Not an issue! Your new card will have a valid date from the date of expiry. So, as long as you receive it, and your employer doesn\'t have a problem with you working till it comes in, it shouldn\'t be an issue. If, however, it hadn\'t been approved prior to the expiration of the previous EAD, it MIGHT have been an issue.
