EAD/H1/485/Marriage question.

If I go to India and get married, do I have to stick with my original h1b sponsorer until wife gets her green card thru follow to join process?

I have completed over 400 days since my ND for my 485 and currently hold a valid h1.

Also, if I do change jobs on ead, (loose h1), is there a way to get my wife here?

I don't think it is necessary to wait on changing companies until your wife gets her greencard.

But you definitely need a valid h1 to bring her here. So don't change your company until she gets her H4 stamped and enters the US. After that you can apply for her AOS, once she gets her WAC number she is legal and you can go ahead and change your job on your EAD since she is now an adjustee and doesn't require your H1 for her status.

BTW, Congratulations on your decision to get married. :) Please pass our condolences to the poor girl who has agreed to have you (Just Joking :D ). Seriously though, it is good news and a welcome break from the daily INS pessimistic approach.

140, you are such an idiot. Anyway, thanks for your advice. I am still not clear. I am gonna send u an email with my ph #, can we talk on phone about this a bit? It's sorta complex y'know.

The reason for my signature is also to help thousands of people in the same boat. I feel unless the law changes (low probability), you would see a mass exodus of rich young computer people back to India in the next 3-4 years. These all will be green card holders, with heavy bank balances and nice nice stuff on their resumes.

Regarding the signature, I completely agree with you on that. It is kind of dumb that people with H1 can so easily get their wife over in a matter of days but permanant workers don't get the same benefit. More examples of INS screwups. I was just pulling your leg with that silly remark! :) Sorry! :)
 
I feel irrespective of our personal situation we all should still sign the application ( Help for Spouses of GC holders) not that we all need it, but we agree that it makes sense and will benefit lot of people stuck badly with spouses back in India/home countries.

I did my part of filling the application.
