EAD for internship - imp

Hi Friends,

My friend's sister-in-law is on H4 - has applied for medical internship- but they need EAD . She applied for the EAD only on Dec,2002 - so 90 days wil be over only in early March. Can she get an interim EAD OR can she use th receipt (like we can use H1 applied receipt and then go for work)

Working on EAD is not exactly same as working on H1B. To work on EAD legally, you need to have the card in hand. However most people start/continue working as long as it's approved. The reason being is EAD validity date starts from the day it's approved where as H1 validity date starts from RD/ND of your H1 petition. And that's why you can start working with H1 receipt notice.

She has two options to start working:

1. Getting iEAD after 90 days
2. Getting EAD approved

Since this is the first EAD she definitely needs some document to start working, either the iEAD or EAD itself.

It mostly will not be possible to get iEAD after 8 weeks of applying. You need to wait atleast 90 days before applying for an iEAD, but you can definitely try. She might get lucky!
