EAD expiring - help

My EAD is expiring on Dec 12. I have applied for my EAD renewal on Oct 23. My case is transferred to Boston on Nov 7. Atleast it will take Jan to get my renewed EAD.

My attorney is saying I cannot work after Dec 12th untill I get my EAD renewal.

Can anyone let me know what should I do now? Anyone had the same issue before?

can now go to boston INS and get you EAD

Because your case is transfered to boston, you can now go to boston INS and get you EAD renewed onthe spot
 
I guess you might have realized your mistake by now. Let nobody does this type of mistake again. Any one working on EAD should apply for EAD renewal atleast 4 months before expiry of the current EAD. It is infact better to apply 6 months before the expiry (based on my personal experience).
Wish you good luck in getting the EAD renewal on time. Boston office should be able to give you same day EAD.

this is not true because of 90 days rule. As soon as 90 days passed after you Receipt Day, you can go to the local office and get your EAD renewed on the spot

dstaish is abso correct in the advice. His case did get complicated and it is advisable to apply for the EAD as soon as one becomes eligible.

The 90 day rule is valid, but the clock starts all over again if there is a RFE fro EAD. So the interim EAD becomes a problem.

In 485indiaEB3, the interim EAD can be applied only after Jan 23..
 
Went to the Boston INS office on Dec 2, applied for a new EAD for me and my wife they gave the EADs on the same day.

Showed 485 receipt, 485 transfer notice, pending EAD in VSC receipt notice. Didn't ask any question the officer not even interested in seeing these documents.

Woh.., Boston Office is so cool. The Norfolk office (VA) sucks.
 
Whatever the case may be, if EAD expired before renewal. then you should not work which should also reflect in Pay stub. otherwise it may be a problem.

Take care........next time. plan for extension of EAD atleast 5 months before.

Do you think your EAD was issued on same day because of your 485 being pending in local INS office?
In the case that 485 is still pending in VSC and EAD RD is less 90 days, can we get the EAD from local office?
 
no, you can't

no, you can't
Boston is only issuing EADs to people who have their cases in Boston or if there have been more then 90 (and some people now say 104) days from you EAD RD, and you have no pending RFEs
 
485indiaEB3, can you post details of the Boston INS office, i.e. where it is located and what documents i need to take with me for EAD renewal?
looks like i will have to go there too. been over 2 months since applied for EAD, no reply yet.
