ead expiring...

Hi folks!!

My EAD is expiring mid March. The 90 days will get over end of the month. So I cannot get Interim EAD till then.

How do I get out of this mess?! If I tell my client that I cannot work, I may lose my job!! Can I work for free? Is that legal?

Help!!

somewhere I heard that you can still work if you had already applied for RENEWAL of EAD and you have the receipt letter with you. But I am not positive your best bet would be to contact Rajiv's office on this. Good Luck
 
You cannot work without approved EAD. Unlike H1, you cannot work simply by using receipt number.

Some people have successfully received Interrim EAD by showing proof that they could be laid off if they do not have work authorization. I would suggest you to ask your HR or your Manager to write a letter saying that you could be layed off if you do not produce work authorization beyond suc and such date (after your EAD expires). Take this letter to your local USCIS office and try your luck.

today my company lawyer came back saying that I can work citing the below... is this true?

i'm in the same boat... i told my company that i had to go on unpaid leave...
they said to continue working stating the following from their lawyer..
any comments?

(20) A nonimmigrant alien within the class of aliens described in paragraphs (b)(2), (b)(5), (b)(8), (b)(9), (b)(10), (b)(11), (b)(12), (b)(13), (b)(14), (b)(16), and (b)(19) of this section whose status has expired but who has filed a timely application for an extension of such stay pursuant to §§ 214.2 or 214.6 of this chapter. These aliens are authorized to continue employment with the same employer for a period not to exceed 240 days beginning on the date of the expiration of the authorized period of stay. Such authorization shall be subject to any conditions and limitations noted on the initial authorization. However, if the district director or service center director adjudicates the application prior to the expiration of this 240 day period and denies the application for extension of stay, the employment authorization under this paragraph shall automatically terminate upon notification of the denial decision.

I thought the above rule applies only to H1B candidates. Anyone know does this apply to the EAD too. My personal opinion is it doesn't apply to EAD.

Check with your lawyer whether this applies to EAD too.
