EAD Expiring - renewal not approved yet

My current EAD is about to expire in a few days. I applied for a renewal in NOV 03 and estimate it will still take about a month before I'm approved. My previous EAD only took 6 weeks to approve thus this time I applied 8 weeks in advance of it's expiry.

My question - can I continue working after EAD expiry or should I apply for iEAD?

You cannot work if your present EAD expires ... no exceptions to that - period.

To get iEAD, your EAD app should be pending for atleast 90 days ...
You can go to the nearest ASC and try your luck ... maybe they'll give you an iEAD ... you have nothing to lose.

Next time, apply atleast 4 to 5 months before the EAD expires.
 
Not really fair is it - becasue of their back log I have to file sooner and spend money. Also I have to anticipate how long it would take them. Maybe next year 4-5 months is not good enough and it takes them 6 months!

It won't get that bad ... if your EAD app is pending for more than 90 days, you'll get iEAD to continue working.

You get into trouble only when you apply for a new EAD when there is less than 90 days left on ur current EAD.

For the most part, EADs get processed in about 60-70 days. Its a hassle to get iEAD, but surely better than not being able to work at all.

Unpaid leave would work....don't have to quit.

If its a small size company, you can get into an "agreement" to get paid later ( this is not legal - so its obviously risky - but has been done before).

What are the options of working with Interim EAD

My wife's first EAD expires on 6th Feb, 2005 where as the renewal has a receipt date of Nov 9th 2004, that means we can only go for an interim EAD after 9th Feb 2005. What does she need to tell her employer to do? she can simply tell them that she can't work for those three days as she will not have an EAD, but is that official and legal? She works on 1099 (Independent contractor) and hence doesn't get a W2 or something.

What official documentation she needs to have to not have problem in future.

Its such a stupid situation that though we applied before 90 days period, it just took 2-3 weeks to actually get the receipt notice, can't help it.

I got an iEAD a few hours ago!
Thanks for all the advice. Now it's my turn to give some back.

I set an appointment in the Chicago office for iEAD (not the general consultation - but appointment specific to appying for EAD after 90 days) Even though my EAD renewal application was not pending for 90 days (only about 50).

I went to the office on Jackson, went through security and in a line at the door upstairs. Here they checked the appiontment letter and told me to go sit in the EAD waiting area. As it turns out they forgot to tell me I should leave my appointment letter in the EAd inbox. I waited about 20 minutes and then an INS lady asked me if I'm waiting for EAD. I said yes and she was upset because I did not leave my letter in the inbox. No use arguing so I just smiled and apologized. Next she shouted that I should have filled out an application. No worry, I already had a typed I-765 application with me. Next she wanted drivers lisence and old EAD card. Next she wanted I-765 receipt notice and I-485 receipt notice. I gave all to her. Next she wanted to know who is sponsoring me. Said my employer, she wanted to know the name - so I gave her letter from employer stating that I will be laid off if EAD expires. She read maybe first 2 sentences and lost interest and gave the letter back to me. She told me to go sit down and wait. She did some typing on the PC, lost interest in that and started a conversation with some co-workers. After about 5 minutes another person approached her with an emergency AP question. She shouted "Wedding is not an emergency" and then told him to wait. At least this guy broke up her conversation with her co-workers. She resumed typing and then called me to the front again. She had a card with my name DOB and A# on it. Asked me to verify the typing. Employee # 2 took my right index finger print and Emp #3 took my photo in the next room. Back to the waiting area. 2 minutes later I was given a iEAd valid for 3 months.

The 90 days never even came up in the conversation, there was no begging or explaining needed!
Passport was not asked for

Good she didn't ask you about the 90 day stuff and all that ... sounds like she would've just screamed at you for that !!

INS should not be allowed to employ red-headed women! LOL

Even though the lady that helped me was rude I did notice that all the other ladies there were extremely polite with the "customers". And bottom line is she did give me iEAd so I can not really fault her too much!

I would not start working on an ulcer just yet - you may still get the EAD before Feb. If anything try to set an appointment for 5 Feb right now so that dates does not get filled up. You can always cancel the appointment if you get the EAD before then. I would really be surprised if they do not give you iEAD a few days before 90 days - especially if you can prove that you submitted the application 2 weeks earlier. And if they do it is your worst case of taking a few days unpaid leave.
