Hi,

My wife's EAD is expiring on May 6th and she has got a job offer and is supposed to join on Apr 16th. I applied for the EAD renewal only on Mar 16th. EAD processing is taking 2-3 months, what will the employer do in this case ? Its a new job, she has never worked before in the US.

When she joins the company she will have a valid EAD, which will expire in 20 days. Please advice.

Thanks in advance,
Vasu.

The employer will require a valid EAD at all times. If EAD expires, your wife cannot continue to work.

I can think of 3 options:

1. Go to the local INS office, explain the situation and request for an iEAD even though it isn't 90 days yet. Some folks have been lucky and have managed to get a iEAD before the 90-day period

2. She could work for 20 days and then take a vacation provided the employer agrees and rejoin after getting the EAD

3. Start the new job after you get the EAD or iEAD after 90 days.
