EAD expiring immediately...do I have options?

Trust me, I'm no fan of too many posts and opening new threads on this forum but maybe somebody can throw some insight into this situation.

Current EAD expires next wednesday, renewal applied for 95 days before expiry date (though USCIS did not register it until 88 days to expiry), no sign of renewal card, no updates, nothing. Did have biometrics (or was it FPs?) three weeks after applying for renewal. Since then, nothing.

Though I'm trying to schedule an INFOPASS for Tuesday but I seem to get the idea that district offices NO LONGER issue interim EADs. They did that exactly one year ago when I was in a similar situation but in that case the Immi Officer had to get involved. He is not involved at all this time.

My former lawyer had stated in an e-mail at the time of last renewal (which also was getting delayed) that there is "some" provision that "may" allow an applicant to continue working for 180 days on an expired EAD if they have re-applied for a renewal AND if they have already filed for adjustment (I-485, I assume, which I have). Does anybody know this to be true?

Lastly, what are the best options I have in this situation? Do I quit work, take a break, feign illness, or continue working (maybe unpaid?)? I'm looking for any information, experiences etc. that are similar to my situation.

Thanks indian_gc_ocean! The information on this thread is quite useful and I also see the enormous pain people are going through to get their renewals. It is such a pity to be screwed at such last stages of GC processing.

This thread still does not clearly answer whether or not one can work at the end of 90 days. What if the employer is okay with you working while you wait for the approval? Does that put them at risk? Do they get fined $10,000.00 by USCIS? And have you become illegal on day 91, and subject to deportation?

This is such a grey area and nobody (lawyers, USCIS, AILF etc) wants to step in and make a definitive statement, and back it up with a clear mandate/memo on the subject.

The issue is also not simply a matter of "not" working for a day or two...what if your approval does not come through for 15-30 days or more? Imagine the plight of that individual...and all for NO fault of theirs. Naturally, tempers will run high.

However, one thing that I did find practically useful is to write to USCIS as other posters have mentioned and request my case to be expedited. We'll see if that makes any headway...
 
You are not supposed to work if your EAD got expired period as I was told by Immi Officer. Take a break dude.

I have similar problem but I have time till this month end. Sent an expedite request but was denied because my supporting documents failed to establish that there will be a severe financial loss without EAD. My only source of income is my job and I cannot work without an EAD. I do not understand what else could be called as severe.
My plan is to not to work until I get the card. Another thing we can do is to PRAY :mad: which I am doing daily

Sending an overnight letter and requesting them to expedite or asking the congressman's office to enquire does not always make any difference. Those morons can't keep track of filing dates and expiry of old EAD dates, which is very obvious. If they are processing receipt dates of 10/31, then how did they miss RD of 10/23? And why haven't they processed and sent it yet?

Much to my disappointment and with some reservation, I have decided to take unpaid leave from work starting tomorrow until this mess gets sorted out. It will be interesting to explain to a bunch of people why I cannot work...but so be it, I guess.
 
EAD Approved

:) My EAD renewal application is approved just two days before the expiry date of old one. Prayer and hope are the only effective strategy in desparate times with USCIS
