My EAD expired on 9/14. My renewal is still pending. My employer terminated my employment. And my employer told me if I reapply the job later, I have to start as new employee which means I lost all my benefit (no medical / dental insurance for the first year / less vacation) for working 5 years with them. As I understand, under normal situation like disability / quit for school or other reasons, when they reapply the job again, my employer will bridge the service so the applicant will not lost the seniority and benefit as new employee. Since I am related to expired EAD, they treat me differently when I reapply the job.
Is it consider job discrimination? Is there anything I can do to have the same treatment as a regular employee regardless to my EAD issue?
Also, how can I expedite my application? I have contacted USCIS but since is less then 75 days, they refuesd to expedite.
I am in financial crisis now as I am jobless. Is there any agency / law will protect / help people in this situation?
