EAD Expired but working on H1

I am currently employed with my H1B employer and my EAD(which i never used) expired Dec 04/02 . My current H1B expires in April 2003. Can i apply for a renewal of my expired EAD now since i might need to use it after my H1 expires? Any help/feedback would be appreciated.

Yes.

You can apply for renewal of your EAD. In fact that's what you should do now in my view.

Is the H1 Stamp on your passport less than a year after expiry?

The H1 stamp on my passport is valid till April 15 2003

Once you apply for EAD you are on EAD status. Your H1 is null and void. Anywork done with H1 and EAD expired would be considered illegal. Talk to your attorney before you screw up your case.

Just getting a EAD does not nullify the H1.
