EAD Card

Hey,

This is a question for the lawyers and gurus in this forum..

If you asylum has been granted and you are waiting for adjustment of status (receipt date 09/16/99), do you need to have a valid EAD card?

I had read that you do need to have a valid EAD? Is this correct or wrong?

My wife's EAD card has expired and we did not try to get a new one since I read that it is optional for asylum granted people.


Please advise...

this subject has been discussed numerous time, you can search for it, in summary, you do not need an EAD if you are an asylee. I am heading to work now, later i will post the USCIS memo about that.

Asylees and Refugees DO NOT need EAD

I recently stumbled on this forum and can definitely say that it is great. I found lots of useful information in just couple of days.

So here are my 2 cents:

USCIS memorandum that explicitely says that asylees and refugees do not need an EAD.

I printed it out today and went to local Social Security Administration office (South Bend, IN) to request a new SSN card with no restrictions. The lady there was familiar with the issue and readily accepted the application. She told us that we will get a new unrestricted (no EAD requirement) SSN card within a few days. She also said that for refugees it takes longer to verify it than for asylees).

It is interesting that the memorandum is dated March 2003. I applied for my last EAD renewal in June 2003 and thay cached in my check and sent me a new EAD without informing me that I don't need to do that.

Of course they would take your money. You sent it to them. It is up to you to figure out that an EAD is no longer required.
