EAD card not recieved , Reciept says Current Status: Card production ordered.

hi,
I'm very worried for few days as my EAD card is not here and my H-1 is expiring in couple of days. my I-765 application notice says Current Status: Card production ordered on oct 5th 2007, my fingure printing is done last week and also my I-140 is approved in March. My concern is that is the reciept notice of I765 saying Current Status: Card production ordered, work as a approval notice?? Do I have to have the EAD card or any Iterim EAD card before the H-1 expires? or this I-765 recipt notice will work for me. Should I go to USCIS and ask for the interim EAD or Apply for H-1 renewal... Gurus .. please give some advise...thanks
 
I think you should talk to your employer about this situation ASAP and have them extend your H1-B. I think you should not work even one day without a valid status (EAD in your hand or H1-B applied for). There should be no gap between H1-B and EAD if you want to switch. Also there should be no gap between H1-B either.

Call USCIS also and ask about the EAD. But most importantly, have the attorney prepare the H1-B extension and have them apply it before your current one expires.

I spoke with my lawyer and he said that since u have your I-765 reciept ypu should be ok legally working. But I was concerend with the notice that says card in production , instead os saying approved.... please tell wat should I do

I do not think the status will say approved on I-765. You might check other posts that got EAD so far but I think the "Card production ordered" means it is approved and the card is on it's way to your mail box.

Also, the website should not be taken as legal proof. I think you should still talk to the USCIS just to be on the safe side.
 
after seeing "Card production ordered" message you should get your EAD in 10 days.Almost all my friends got it like that. Since you are on Adjustment of Status you don't need to worry about H1 expiry. You are leagal to stay and since your EAD card production ordered you are leagal to work.
 
I got my EAD card today in the mail. To give you my timeline:

Oct 22 Card ordered (day 0)
OCt 23 Could see the lud on the CRIS website (day 1)
Oct 25 Card was put in the mail box (day 3)
Oct 26 Card was shipped by postal office (day 4)
Oct 29 Card arrived in my mailbox (day 7)

I havent recieved my card yet and no update on the USCIS website as well. I called USCIS and the lady over there said that I can work even if my H-1 expires coz my card is ordered for production and that means case is approved. So i hope everything wroks for me even if i dont get the EAD by next week, when my H-1 expires.:mad:

What questions should I ask and and what not. My H-1 is expired and ned to findis the=ier going to be any problem coz my lawyer said since u r approved in the system you dont have to worry.? Should I ask for the iterim card?? please help

That sucks but at least you don't have to go through applying for another H1B again. I would ask them how can you work without the EAD in your hand. Probably you will need to use it pretty soon to fill the I-9 form with your employer. According to their posted times the EAD should take 11 weeks from the date of the filing.

Seems that something is delaying the production of the card or the status on the website is out of date. As you see in my sig, I saw card emailed message before I received the card (actually I received the card first and then I saw the LUD because I did not check my status online in several days back then).

So good luck tomorrow! Hope you'll get your EAD soon.
 
I have the same case, I have not received my EAD card and online status saying card production ordered. I have been waiting for 2 months, when I called USCIS Nebraska, they told to re-file! WTF?!? I asked my lawyer, he said since I have got approval notice, it's mean I am okay and can carry on But I am still worried since it was written on the approval notice that the approval notice should only be used for legal purpose for first 30 days until the card arrived (or something like that).
 
Just writing to let everybody know my updated status.

I just received an email saying my EAD card is in the mail to my personal resident address. Below are the detail:

I applied on July 2nd
Receipt date September 10 2007
Approval notice date October 4 2007
Online status saying 'card production ordered' since October 1 2007
Online status updated to 'card mailed' on November 28th 2007

Contrary to what most people think that they will get EAD card within 10 days or 32-36 days after the 'card production ordered' message, mine was sent way over 36 days. Use this information as you wish.
 
Great to hear that. I hope you get it in the mail next week. Sometimes it takes a few days to receive it from the date it is posted as mailed online. For example, look at my AP. It was mailed Tuesday and I still did not receive it today, Friday. I will start calling them on Wednesday if I don't receive it in the mail.
