As per the online status my EAD is approved

On November 21, 2003, after approving your application, we ordered you a new card. Your card will be mailed to you as soon as it is ready.

My H1-B expires in Dec first week.

Do I have to receive this EAD card before the H1 expiry date to continue working with the same employer?

Thanks for the info

Concurrent Filing. EB2 RIR. 140/480/EAD with ND 7/22/03.
RFE on 140 on company financials on 9/3/03 response received by UCIS on 10/31/03 (Fedex delivered to them on 10/8/03!)

140 approved on 11/17/03

EAD approved on 11/21/03

a) Congrats

b) You dont have to receive EAD card in hand.. for first three days after your H-1 B visa expired. So if H-1B visa expires on 12/07... you are good till 12/10... Hopefully you should receive EAD card by then

c) You lucky ...... I-140 approved in less than 4 months....

vxmehra98 -

Thanks. What happens if I dont receive my EAD before the 3 days? (Thanks Giving is in the middle).

Will the local Boston office issue me an interim EAD depending on this EAD approval?

Surley the date of your EAD approval is the important thing here ( regardless of when you physically receive the card in your hand ) After all when you get it you will see that the date it is valid from on the face of the card will be your approval date. I think you are fine to consider yourself to be in EAD status now.

How is this possible? BCIS website says they are processing Oct 2002 cases. Anything special about your case mvk2002?

Hello mvk2002,
Congrates!!!
Can you please tell us how this super-fast processing has gone through.

Thansk

Thanks for the info.

Can anyone tell me whether the EAC number for the EAD is the EAD number?

Once I tell my employer that I got the EAD what the employer do? Does the firm needs an EAD number to convert me to EAD from H1-B?

Like many other cases, I am just lucky. I saw approvals of cases dated beyond me, but approved before me. There is no pattern. May be the RFE in my 140 triggered the approval.

But in this forum we saw approval without RFE too! If I remember correctly there was a 140 approved within 3 weeks of ND!

Attorney says once EAD is approved, employee / employer need not do anything to switch from H1-B to EAD.

As and when I receive the EAD, I just have to fax it to the HR for their records!

And I dont have to receive the EAD card before the expiry of the H1-B. As the approval date of EAD is prior to my H1-B expiry, I am all set!

Thanks

What is this 3day rule? where did you find this?

dynobuoy,

3 day rule is not related to immigration but to Human Resource.

HR would require you to provide the necessary employment authorization paperwork within the first 3 days of work or within the first 3 days of the expiration of current employment documents.
