i wish that was the case!!! Its still not safe to change employers as your I-140 is not aprroved..i am in a simlar position and waiting to change employers..but as usnycus

says ..its better to wait for 140 to clear as till then your employer has the way to revoke it,,

So is it safe to switch employer if I-140 is approved and I-485 is pending more than 180 days. Also is it true in case of concurrent filing?

Yes... You can join new comapny as soon as you can if the following points matches:

No matter Concurrent / non concurrent .. if your 140 approved and your 485 is pending for more then 180 days.

If I have H1, do I still need to apply AC21. Also how long it take to get approval for AC21? Can I file it myself or I need a lawyer for this.

AC-21 is not a application for approval. This is just notification for INS that. you changed a similar or same kind of job and your new employer is ready to support your I-485.


My suggestion is go for a lawyer .,. since they will a standard credential and format for that.

I spoke to the attorney of company A and he said EAD means I can work for any one

just need to make sure that duties are the same
as long as I don't quit from my company I am fine
I am allowed to work for extra income
Also I will work for my consulting company as soon as they get me a job mostly they never get me a job..
so Good Luck to you all and please don't be afraid the law is to protect us and not to create trouble.
