EAD Application

I didn\'t apply for an EAD when I submitted I-485 to VSC. Can I apply in the local INS office when I get the I-485 receipt? How long does it usually take? What documents are required? My impression from the INS web site is that you have to file the application to the same office where you submit your I-485.

Would someone please shed some lights? Thanks very much!

1.9 cents

You can file it after 485 filing. Require proof or current status and evidence of eligibility. Takes a minimum of 1 month. If more than 90 days after EAD filing haul your butt to a local office and request an interim EAD.

My problem

Thanks a lot for your 1.9 cents! :-)

My problem is I\'m still waiting for the I-485 receipt and I don\'t expect to receive it in a month, but my H1B will expire at the end of January 2002. So I can\'t wait 90 days to go to a local office. Could I go to the local office as soon as I get the receipt although I applied I-485 to VSC?

Anyone that has the same experience or some knowledge please share your opinions! I appreciate all your assistance!

Ask your lawyer for proof of filing...

You can use that proof (copy of app, fedex receipt etc.) and go to the local office to enquire. Chances are they will ask you to mail in the app to the service center (VSC) with that evidence. You can get the app on the ins website (765 I think). Read it carefully for instructions. Hope this helps.
