Good morning,
I am newly registered to this forum, but have searched for several days to find an answer to my question. I could not find something to clarify it, so I decided to post my situation.
My wife and I applied for asylum at the end of April 2013. As you all know, most of the cases are on hold, or slowly processing, so we have not received an answer (my wife never received a receipt for her application - she is the one that filed for asylum). We did get the bio-metrics document, and we went in for fingerprints somewhere in May. Since more than 150 days have passed, we can apply for EAD. I have found different comments regarding the EAD application, and some of them say that a cover letter is needed, some say that just send in the I-765 with supporting documents.
Here is what I came up with, just need some help, if anyone knows if this is the correct way to do, or anything needs to be changed or added:

RE: Form I-765, Application for Employment Authorization for <My Name>, A# ###-###-### – I-589 Pending (Application for Asylum) – Receipt # <################>
Dear Madam or Sir,
Our Application for Asylum (I-589) is pending (Receipt # <################>).
In connection with the above-referenced matter, enclosed please find the following supporting documents for <My Name>, husband of <My Wife's Name>:
• Completed Form G-1145, e-Notification of Application/Petition Acceptance
• Completed Form I-765, Application for Employment Authorization
• 2 passport style color photographs
• Copy of Form I-797C, Fingerprint Notification
• Copy of Passport’s Biographic Page
• Copy of I-94 form (front and back) and entry Visa from the Passport
• Copy of Marriage Certificate
Copies of documents submitted are exact photocopies of unaltered documents and I understand that I may be required to submit original documents to an Immigration or Consular officer at a later date.
Please approve my application for Employment Authorization. If you have any questions or need additional information concerning the above, please do not hesitate to contact me.
Thank you in advance for your kind attention and cooperation in this matter.
Sincerely,
<My Name>
<My Address>
Tel: ###-###-####
-------------------------------------- END COVER LETTER --------------------------------------
The rest of the documents are as noted in the supporting documentation list.
Also, on the I-765 form, field 15, asks for Current Immigration status. I entered US with a H-2B visa, but it is expired. What do I have to fill in there? Am I currently Out Of Status, or a different status, having an asylum pending for my wife?
Field 16 on the same form I guess is (c)(8) - pending asylum.
Thank you very much for the help.
