I have a unique case.We are planning to move to India , this summer,Myself & my kids.My spouse's state depends upon where he gets his job
Currently, we are in US.Our AP(mine & my child's) and EAD(mine) are about to expire in Sep2010. We are not in H4 anymore.
From what I read in certain forums ,once AP expires one cannot enter US.
We cannot come to US until next Summer.
1.What do I have to expect in case My spouse gets a job in US.?
2.What precautions do we have to make before leaving US?
3.Is there any possibility to get AP alone for a period of 2 years(We do not have GC,We are still in 485 stage only.)

Pl. advise.

When you say you are moving to India, do you mean permanently? Or will you return to the US as soon as your husband gets a job in the US? If permanently, then you may not need to worry about the GC process anymore.

Basically, you need a new AP if you want to return after Sept 2010, and this new AP must be approved before you leave the US. Unfortunately, right now APs are only granted for 1 year only. So 3 months before you leave the US, apply for a new AP for everybody so you'll be sure to get it before your departure date. If you leave the US before you get it, you won't be able to use it to return.

Yes there has been talk of having a joint EAD/AP card, and since EADs are now sometimes issued for 2 years, it follows (based on rumors) that the joint EAD/AP card would also be two years. However, even though USCIS stated that they were considering such a card, it hasn't been formally announced. With USCIS, nothing is certain and nothing is fast. So for the time being, this card is just an idea and not a fact. Bottom line: right now there is no way to get a 2-year AP.
