My wife got this complicated situation that needs your help.
She has been worked in a University for 3 years on a academic H1 and the current H1 expires on June 30. The univerasity has petitioned extention for her but no approval yet.
Our 1485 is pending in VSC, my 140 was approved.
She has got an approved EAD last month.
Now she got a new job offer from a company and the company told her that they can sponsor transferring her academic H1 to an industry H1. Her start date with the company is July 18.
Our questons:
1. Should she use her EAD or transfer her H1? Using EAD will be easy but we still are a little worried since our 485 is still pending. In case sth wrong with 485 she will be out of status if she is on EAD.
2. If she uses her EAD to work for this company can they apply for a H1 for her at a later time?
3.If she transfers H1, does she have to wait till after the H1 petition got approved to start working?
4.Her AP is pending in VSC and she plans to go back to China early July wtih AP. What status will she have after coming back to States if she is going to use EAD, or tranfer H1?
