EAD and working on 1099.....

My lawyer is advising me not to go on 1099 at all. Not even for part time.

My PD is 2/2003 and it will be a while before my case will be picked up.

Now I am confused....??? This 1099 offer is really good and now I am feeling frustrated that I can't take it because of some unclear law.

Has anybody tried this?

Your GC can't be approved if you do not have fulltime, permanent W2 job. However if your PD is retrogressed by few years, you can take a 1099 job on EAD, then switch to fulltime W2 job few months prior to your PD becoming current.

Armie, What is the source of information for this "GC can't be approved if you do not have fulltime, permanent W2 job" ?

There is no source, I am just making this up. Good luck with your GC.
 
This is nothing but common sense, you have applied for an employment based Green Card which is being sponsored by an employer. 1099 means that you are self employed, which essentially means that you are sponsoring yourself (if you choose to work on 1099). If this was acceptable by USCIS then everybody could come to US and project as self employed and start the green card process. I haven't seen or heard of any such cases. The EMPLOYMENT based GC is ALWAYS sponsored by an EMPLOYER.
